I understand and agree that participation in the above Activity may involve foreseeable and unforeseeable risks and hazardous activity which may be dangerous and may involve the risk of severe injury, and/or death, and/or property damage to myself or others. As such I attest and agree to the following:

1. I certify that I am physically fit for this Activity and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity; and

2. I freely and voluntarily am willing to participate in the above described Activity; and

3. I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN THE ACTIVITY, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of myself, and/or other persons, and/or structures or land that the Event is being taken place at; and

4. General Release. Knowing the risks described above, I agree, on behalf of my family, heirs and personal representative(s), to assume all the risks and responsibilities surrounding my participation in the Activity. I hereby release and discharge, and agree that I will not institute, prosecute, or pursue any and all complaints, claims, charges, claims for relief, demands, suits, actions and causes of action, whether in law or in equity, which I could assert against Lyndsey Fry Hockey LLC, and individually against Ms. Lyndsey Fry, and Ms. Emily Potter (hereinafter “Company”), and/or its current and former members, shareholders, officers, directors, agents, representatives, servants, employees, attorneys, affiliates, subsidiaries, departments and units, parent and sister corporations, joint ventures, related entities, predecessors, successors, and assigns (hereinafter collectively referred to as “Company” and/or “Releases”); and

5. COVID-19 Release. In addition, I acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk that I, or members of my group or organization, may be exposed to or infected by COVlD-19 by participating in any way in any event, or Activity, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID19 at an Activity may result from the actions, omissions, or negligence of myself and others, and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself or members of my group or organization, including, but not limited to, personal injury, disability, and death, illness, damage, loss, claim, liability, or expense, of any kind, that they or I may experience or incur in connection with participation in any event, or Activity. I hereby release and discharge, and agree that I will not institute, prosecute, or pursue any and all complaints, claims, charges, claims for relief, demands, suits, actions and causes of action, whether in law or in equity, which I could assert against Lyndsey Fry Hockey LLC, and individually against Ms. Lyndsey Fry, and Ms. Emily Potter (hereinafter “Company”), and/or its current and former members, shareholders, officers, directors, agents, representatives, servants, employees, attorneys, affiliates, subsidiaries, departments and units, parent and sister corporations, joint ventures, related entities, predecessors, successors, and assigns (hereinafter collectively referred to as “Company” and/or “Releases”); and

6. Indemnification. To the fullest extent permitted by law, I will indemnify and hold harmless the Company and Releases for any loss, damages and/or costs incurred by the Company by reason of any act or omission performed or omitted by the Company in connection with the Activity, and for any injury to person or property, or other damage, which I may suffer, or for which I may be liable to any other person, related to my participation in the Activity that results from any cause, including but not limited to negligence on my part or on the part of any of the Releases. I agree that this Waiver and Release may be pled as a complete bar to any action or suit before any administrative body or court with respect to any complaint, charge, or claim arising under this Waiver and Release.

7. Photo and Video Release. I hereby give and grant in perpetuity to the Company, and its representatives, successors, assigns, licensees, employees, and any person, corporation or entity acting under its permission or with its authority, or for whom it might be acting, including anyone distributing or disseminating advertising or other communications by or regarding the Company (hereinafter collectively referred to as the “Licensed Parties”) the irrevocable right, permission and license to publish, reproduce, distribute, and/or otherwise use:

a. my name; and

b. any still or moving photographic image, likeness or sound recording of me (the “Performance”)

in such manner, for such purposes, and with such frequency, in whole or in part, as the Company shall determine in their sole discretion, without further compensation or consideration to me and without further authorization by me. I expressly acknowledge that such materials authorized and released may be used in, among others, internet and other types of media now known or hereafter developed. I disclaim any interest in the Performance and further acknowledge that they shall constitute the sole property of the Company. This Release shall be binding upon my heirs, successors, assigns, and personal representatives, without regard to whether it is expressly acknowledged in any instrument of succession or assignment.

READ, UNDERSTOOD & AGREED

I certify that I am age 18 or older. I have carefully read and freely signed this Activity Waiver & Release Form. I agree that this Waiver and Release Form shall be governed by the laws of the State of Arizona (notwithstanding its conflict of laws principles), which shall be the forum for any lawsuits filed under or incident to this Waiver.

In the event that I am not 18 years or older, I, as a parent, or legal guardian, on behalf of my child and myself, I accept full responsibility for my child’s participation in the above Activity and I agree to all of the terms and conditions contained in this Hockey Activity Waiver and Release Form.
